Hillsborough County:

FHSAA can’t come to agreement with FPAE

Florida High School Athletic Association executive director Roger Dearing could not come to an agreement with Florida’s Parents for Athletic Equity by the Friday deadline regarding possible violations to Title IX, FHSAA spokesperson Cristina Alvarez said.

FPAE’s lawsuit is based on the FHSAA Board of Directors April vote to reduce all varisty games, except football, by 20 percent was in violation of gender equity.

Attorney Nancy Hogshead-Makar, who represents FPAE, said if Dearing doesn’t schedule an emergency board meeting on or before June 26th [to accommodate Dearing’s vacation time], “we will be filing the lawsuit the first of next week.”

“He wants a mid-to-late July date,” Hogshead-Maker said in an email. ” If they don’t pass something, that leaves us flat-footed. The schedules would already be set.”

The board was expected to discuss recommendations to amend the game reduction policy earlier this month, but when threatened with a lawsuit by Hogshead-Makar, postponed the agenda until the next board meeting in September. Unhappy with the board’s decision, Hogshead-Makar gave Dearing 10 days to equalize the number of male and female athletes affected by the game reductions or she would file suit on behalf of FPAE.

“We have exhausted our good faith attempt to obtain resolution of this matter,” Hogshead-Makar said in an email sent to the FHSAA board of directors.
