TAMPA - A part-time Palm Harbor resident who says she was sickened from eating peanut butter has filed a federal lawsuit against the manufacturer seeking $5 million in damages.
Marion Caldarera, 63, who also lives in New York, came down with gastrointestinal problems after eating the peanut butter she bought at a Pinellas County Walmart, said her attorney Edward Zebersky of Hollywood. He did not know which location.
The suit, which seeks class-action status, is among numerous similar suits filed in courts around the country since the peanut butter maker, ConAgra Foods issued a nationwide recall Feb. 14 of all Peter Pan and Great Value peanut butter made at its Georgia plant after federal health officials linked the product to a food poisoning outbreak that began in August.
Lawsuits have been filed in Fort Lauderdale, Georgia, Texas, Oklahoma, New York, Pennsylvania, Seattle, Chicago and St. Louis, according to news reports.
Spokesmen for ConAgra and Walmart declined comment on the lawsuit Thursday.
