Aisenbergs Drop Suit

TAMPA - Marlene and Steven Aisenberg, whose infant daughter Sabrina vanished in 1997, are dropping their civil lawsuit against investigators, according to the Hillsborough County Sheriff’s Office.

Sheriff’s spokesperson Debbie Carter says the Aisenbergs filed a “notice of voluntary dismissal” today. 

The couple had sued the sheriff’s office over its prosecution for lying to investigators. They had sought millions of dollars in damages.

A call seeking a comment from Barry Cohen, the Aisenberg’s Attorney, was not immediately returned.

The sheriff’s office issued a one sentence statement.

“While we are pleased with the dismissal of the lawsuit, which has served as a distraction in this case, our focus always has been and remains on finding out what happened to Sabrina Aisenberg,” Carter said.

Feederal charges against the couple were dismissed, and the federal government was ordered to reimburse the Aisenbergs $1.5 million in legal fees after judges ruled that prosecutors and investigators had lied about evidence in the case.

Sabrina has never been located.

Lawyers don’t take proceed with cases they dont think they can win?  It’s about making a living, not about the money.  Cohen has bills just like the rest of us, why should he finance a battle that won’t pay off?  There was no settlement, it boils down to basic playground logic, you fight the fights you can win.  I must agree though, the Aisenbergs have “Guilty” tattooed on their foreheads: they are now exclusive members of the club that includes OJ Simpson, Michael Jackson, Gotti?

The same people saying these people are guilty would have been the same people letting OJ off at trial.  What part of LIED through their teeth don’t you understand?  A federal prosecutor was reprimanded and the government was forced to pay their legal fees.  The only evidence they had to mount this supposed investigation a garbled recording from a television program picked up on a redneck listening device placed in their BEDROOM!!!  Boy when people decide they don’t like somebody they will believe anything.  The same thing happened to me when I went up North.  There are idiots everywhere.

How did comments on a missing child lead to all this other ignorant dialogue?  Some people are just full of hatred and venom.

I do think the parents still have something to do with this case and they should still be investigated.  And if Barry Cohen could win, he would not have dropped the case against HCSO.  He loves to be on tv!!  I know he is a defense attorney, but I hate the way he defends such guilty people!!  Something about Barry Cohen just really creeps me out.

aj jones, this case was not settled out of court. To settle out of court one has to notify the court and have the record sealed so no one can talk about the settlement. The only thing they can make public is the case was settled out of court but cannot comment on the terms of the settlement. This case was dropped by Cohen because he know he could not win, hence he would not get paid. zipper

Ira T. Rosen- I think you need to keep your opinion to yourself. Bad people come from evey walks of life. They come from the north, south, east and west. They also come from all colors.It is not where a person comes from that makes them do things they should not do.
I think you need to do an attitude ajustment.

Well said Bonnie Calhoun.  There is something fishy here. If Cohen thought he could win this case he would have proceeded with it. This just proves that a greedy lawyer will not proceed because he knows he can’t win. This places suspicion right back on the suspects, right where it should be. Lawyers who sue only do so to win for publicity and of course to get a part of the settlement. No settlement, no pay for the lawyer. Tells you something right there. zipper

I was in the legal field for 15 years and I can tell you about evidence - you can’t tell me that you leave the garage door open and the door to your house unlocked and when someone comes in to steal your child that your dog doesn’t bark - well I am here to tell you that my neighbor says they can tell the difference in my dogs bark (someone walking down the road vs someone pulling in the drive) - I don’t buy any of their story. My family also personally knows one of the detectives in the case and this detective has always been at the top of their game so if they feel that they are guilty then I agree with them. Again look at the evidence, it doesn’t lie!

Did any of you, who are blaming the parents, read this article?  It states that judges (meaning multiple) ruled that investigators LIED about evidence in this case!!!  Just like every other case where a child is missing - the parent’s did it!  Please - why would they choose one of three children to get rid of - do you even think about what you are stating or listen to yourself.  Look in North Port - must be the parents - they had a dirty house!!  Come on why one out of seven children would they murder?!!!!  The police are lazy and do not want to look further then the tip of their noses!!! mad

Lisa,no none broke into the house.The garage door,and door going into the house were left open and unlocked.Don’t you make sure your children are secure at night while everyone is sleeping??If for no other reason,wouldn’t you secure your home at night to prevent young children fro wandering away at night.This is very basic common sense

In 1997 no one could believe that someone would or could break into someones house and steal a baby. I believe these poor parents were under fire simply because it had never happended before.It was always more likely a child to be snatched from outside playing or at the bus stop. Now babys get snatched from inside the home all the time! Would we have found the baby had the police and investigators had an open mind?

Well what a suprise. Could it be that Barry Cohen sees that this case is not winnable?

Seems like this is the case. Cohen only takes cases he thinks he can win and get the most publicity because if he doesn’t win he doesn’t collect.

Kind of makes me even more suspicious of the Aisenbergs. zipper
