The Florida Supreme Court has ruled that Gov. Charlie Crist did not have the authority to negotiate a controversial gambling pact with the Seminole tribe that would expand gambling on reservations and provide revenue to the state.
Gambling opponents led by state House Speaker Marco Rubio sued over the pact, saying Crist needed legislative approval to enact it.
In a decision released a few minutes ago, the court sided with Rubio.
“We hold that the Governor does not have the constitutional authority to bind the State to a gaming compact that clearly
departs from the State‘s public policy by legalizing types of gaming that are illegal everywhere else in the state,” it said.
Besides a political victory for Rubio, who has feuded with Crist, the decision also could worsen Florida’s budget troubles. The extra gambling revenue was part of what Crist counted on in his promise not to harm public education through his budget cuts.
