Nelson: “Now There Is No Choice”—He’s Suing

Sen. Bill Nelson says he preparing a lawsuit against the Democratic National Committee because for refusing to lift its sanctions against Florida Democrats.

“Now there is no choice,” said Nelson, in statement just released by his office. “I’m preparing a lawsuit.”

Nelson and Rep. Alcee Hastings threatened the lawsuit in a letter last week to DNC Chairman Howard Dean, and got a reponse from Dean last night. In short, Dean wrote that rules are rules.

Dean said the sanctions—refusal to seat a Florida delegation at the Democratic National Convention—will stand unless Florida’s Democratic Party changes its plans to choose its national convention delegates based on the state’s Jan. 29 presidential primary. The primary is too early to suit the party’s rules.

Florida’s Democrats were officially found in non-compliance by the DNC’s rules committee and have until Saturday to submit a revised delegate selection plan. They say they’re sticking with the primary.

No details of the planned lawsuit were given.
