Gov. Rick Scott overstepped his constitutional authority by suspending the rulemaking ability of state agencies, the state Supreme Court decided Tuesday.
The decision came in a court case brought by a south Florida blind woman on food stamps. Scott had suspended the agencies’ ability to make rules for everything from environment to health care until an executive office could review them.
The legislature, the court said, designated the right of rulemaking to the agencies, and would need a legislative amendment to delegate power to the governor.
